These Terms of Service (the "Terms") govern your use of the Fox Valley Web Design LLC ("FVWD," "we," "us," or "our") website and the services we provide. By visiting this website, requesting a quote, or engaging our services, you agree to these Terms. If you do not agree, please do not use this website or our services.
Services & Quotes
FVWD provides custom website design, website development, redesigns, search engine optimization (SEO), AI search optimization (AEO), e-commerce, logo & branding, graphic design, social media services, photography, videography, drone services, and website hosting & maintenance. All quotes and proposals are estimates based on the information provided to us and are valid for 30 days unless otherwise stated. Pricing displayed on this website is subject to change without notice. Please call (920) 434-9772 for current pricing.
Payments & Billing
Projects may require a deposit before work begins, with the balance due upon completion unless other arrangements are made in writing. Invoices are due upon receipt. FVWD reserves the right to pause work, or suspend hosting and related services, on accounts with past-due balances. Recurring services such as hosting and maintenance are billed in advance and remain the property of FVWD until paid in full.
Client Responsibilities
Timely completion of a project depends on the client providing content, images, feedback, and approvals when requested. You are responsible for the accuracy of the information you supply and must have the legal right to use any text, images, logos, or other materials you provide to us for your project.
Content & Intellectual Property
Upon full payment, you own the final website content and design produced specifically for your project. FVWD retains ownership of pre-existing tools, frameworks, code libraries, and know-how used to build your project, licensed to you for use with your website. FVWD may display completed projects in our portfolio and marketing materials unless you request otherwise in writing.
Everything original on this website belongs to us: the text, the code, the design, and every photograph and video, including our aerial drone imagery and our northern lights and wildlife photography. You are welcome to read, share, and link to our pages. You may not copy, scrape, republish, or use our content or images elsewhere, commercially or otherwise, without our written permission. Client names, logos, and trademarks shown in our portfolio belong to their respective owners and appear as examples of our work.
Links, Directories & Third-Party Names
This website links to many outside destinations on purpose: our clients’ websites, search engines, SEO tools, AI chatbots and answer engines, social media platforms, and other resources in our guides and directories. About all of them:
- Links are provided for your convenience and education. A link is not an endorsement, sponsorship, or partnership, and no third party has paid to appear in our directories.
- We do not control third-party websites, tools, or AI services and are not responsible for their content, accuracy, availability, security, pricing, or privacy practices. You use them at your own risk and under their terms.
- Product and company names mentioned on this site (such as Google, Microsoft, ChatGPT, Perplexity, Mailchimp, and others) are trademarks of their respective owners. Their appearance here is for identification and commentary; it does not imply any affiliation with or endorsement of FVWD.

SEO, AEO & AI Visibility
We perform search engine optimization and AI search optimization using industry best practices, honest content, and nearly three decades of experience. Because nobody outside those companies controls Google, Bing, ChatGPT, Perplexity, or any other search engine or AI model, we cannot and do not guarantee specific rankings, placements, AI recommendations, traffic levels, or revenue. Algorithms and AI models change constantly and without notice, and results achieved for one client or in the past are not a promise of future results for you. What we do guarantee is the work itself: performed as agreed, measured honestly, and reported in plain english. Anyone in this industry who promises you a number one position is making a promise the search engines have not authorized them to make.
Drone & Media Services
Aerial photography and videography are performed by FAA-certificated remote pilots under Part 107 of the Federal Aviation Regulations. Drone operations are subject to FAA rules, airspace authorizations, temporary flight restrictions, and weather, which means flight dates and shots may need to be adjusted or rescheduled for safety and legality; safety wins every time. Usage rights for delivered photo and video media are defined in your project agreement. Unless otherwise agreed in writing, FVWD retains copyright in our photography and video and licenses delivered media to the client for the agreed use.
Acceptable Use
We do NOT provide our services to potential clients or websites that promote adult content, nudity, racism, or violence, and we may decline or discontinue any project at our discretion. You agree not to use our website or services for any unlawful purpose, not to attempt to breach, probe, or disrupt the security or operation of this website, and not to harvest content or data from it, including automated scraping for any purpose, without our written permission.
Website Information & Accuracy
The articles, guides, directories, FAQs, and other content on this website are general information, offered in plain english to be genuinely useful. They are not legal, financial, or other professional advice for your specific situation. We work to keep everything current and correct, but the web changes daily and we make no warranty that every fact, feature description, or third-party detail is complete or up to the minute.
Hosting, Maintenance & Third-Party Products
We work hard to keep hosted websites fast, secure, and available, but we cannot guarantee uninterrupted or error-free operation. Domains, plugins, licenses, payment processors, and other third-party products used in your project are governed by their own terms and pricing, which their vendors may change.
Disclaimer of Warranties
Except as expressly stated in a signed agreement, our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, FVWD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities arising out of or related to our website, our content, links to or from third-party websites and services, or our services. Our total liability for any claim shall not exceed the amount you paid to FVWD for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless FVWD, its owners, and employees from any claims, damages, or expenses (including reasonable attorney fees) arising from materials you provide, your use of the services, or your violation of these Terms.
Termination
Either party may end a project or service in writing. You remain responsible for payment for all work completed and costs incurred up to the date of termination. We may suspend or terminate services that violate these Terms.
Copyright Concerns
We respect intellectual property and expect the same in return. If you believe any content on this website infringes your rights, contact us at info@foxvalleywebdesign.com with the specific page and the basis of your claim, and we will review and respond promptly.
Privacy
How we handle information on this website is described in our Privacy Policy, which is part of these Terms. The short of it: we collect little, we sell nothing, and we do not outsource.
Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Brown County, Wisconsin.
Severability & Entire Agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and any signed project agreement, are the entire agreement between you and FVWD regarding this website; where a signed agreement conflicts with these Terms, the signed agreement wins.
Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top tells you when. Continued use of the website or our services after a change means you accept the updated Terms.
